Additionally, nothing on the site shall be construed as a promise or guarantee of results, future earnings or the outcome or results arising from the coaching services being offered by The Expanded Way, but only illustrative concepts and expressions of opinions.

Limitation on Guidance Given to Client

Client understands and agrees that Coach is not licensed or trained as a doctor, therapist, psychologist or any other similar professional. Client acknowledges that Coach has not offered, attempted, or promised to provide Client with any services that require a professional license, and that Coach is not permitted, authorized, or expected to do so.

Coaching is never intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical or psychological condition. Never disregard professional medical advice or delay in seeking it because of something you have read, heard or experienced during a coaching program.

Further information is included in the Contract Agreement that you will be requested to sign if you decide to enrol in a coaching programme with The Expanded Way.

Limitation of Liability

The Expanded Way, its employees and service providers, will not be liable for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary, or other damages, including loss of revenue or income, loss of data, pain and suffering, emotional distress, or similar damages, even if The Expanded Way has been advised of the possibility of such damages, such damages were reasonably foreseeable or The Expanded Way was grossly negligent. In no event will the collective liability of The Expanded Way and its employees and service providers, regardless of the form of action (whether in contract, tort, or otherwise), exceed the greater of £100 or the amount you have paid to The Expanded Way for the use of the website or any service it provides.

Making decisions based on any information presented in our products, services, or website, should be done only with the knowledge that you could experience risk or losses just like any entrepreneurial endeavour. Use caution and always consult your accountant, lawyer or professional adviser before acting on this or any information related to a lifestyle change or your business or finances. You alone are responsible and accountable for your decisions, actions and results in life, and by your registration here you agree not to attempt to hold us liable for your decisions, actions or results, at any time, under any circumstance.

Further information on liability is included in the Contract Agreement that you will be requested to sign if you decide to enrol in a coaching programme with The Expanded Way.

Use of Information

The Expanded Way reserves the right to use and assign all information regarding site uses by you and all information provided by you in any manner consistent with our Privacy Policy.

Copyrights

If you believe your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide a notice containing all of the following information to [email protected]:

Indemnification

You agree to indemnify and hold the Site, The Expanded Way, and its employees and service providers (the “Indemnified Parties”) harmless from any breach of this Agreement by you. You agree that the Indemnified Parties will have no liability in connection with any such breach or unauthorized use, and you agree to indemnify any and all resulting loss, damages, judgments, awards, costs, expenses, and attorneys’ fees of the Indemnified Parties in connection therewith.  You will also indemnify and hold the Indemnified Parties harmless from and against any claims brought by third parties arising out of your use of any content or information or service accessed from this Site.

Governing Law & Legal Actions

You must abide by all United Kingdom laws.  If you are outside the United Kingdom you must comply with all local laws with respect to your online conduct, as well as the export of data to the United Kingdom or to your country or residence.

If you breach these terms and conditions in any way or if we reasonably suspect that you have breach them, we may send you one or more formal warnings; prohibit you from accessing our website; commence legal action against you. Where we suspend or prohibit your access to our website, you must not take any action to circumvent such suspension or prohibition.

If there is any dispute about or involving the website or the Terms & Conditions, you agree that any dispute shall be governed by the laws of the United Kingdom without regard to its conflict of law provisions. You agree to personal and exclusive jurisdiction by and venue in the state and federal courts of the United Kingdom. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the site, any service provided by the site, or the Terms & Conditions must be filed within one year after such claim or cause of action arose or be forever barred.

Severability

If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision of these terms and conditions would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Waiver

The failure of The Expanded Way to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. Any waiver of this Agreement by The Expanded Way must be in writing and signed by an authorized representative of The Expanded Way.

Termination

The Expanded Way may terminate this Agreement at any time, with or without notice, for any reason.

Relationship of the Parties

Nothing contained in this Agreement or your use of the Site shall be construed to constitute either party as a partner, joint venturer, employee or agent of the other party, nor shall either party hold itself out as such.  Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party, it being intended by both parties that each shall remain independent contractors responsible for its own actions.

Entire Agreement

This Terms & Conditions Agreement constitutes the entire agreement between you and The Expanded Way and governs the terms and conditions of your use of the Site, and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and The Expanded Way with respect to this Site.  Notwithstanding the foregoing, you may also be subject to additional terms and conditions, posted policies (including but not limited to the Privacy Policy), guidelines, or rules that may apply when you use the Site.  The Expanded Way may revise this Terms & Conditions Agreement at any time by updating and posting it on the Site.  Accordingly, you should visit the Site and review the Terms & Conditions periodically to determine if any changes have been made.  Your continued use of the Site after any changes have been made to the Terms & Conditions Agreement signifies and confirms your acceptance of any such changes or amendments to the Terms & Conditions Agreement.
