 As part of the normal operation of the Site’s services, we collect and, in some cases, disclose information about you.  This Privacy Policy describes the personal information we collect about you, how The Expanded Way may use such information, and what may happen to that information when you:

  • Subscribe to our mailing list for newsletters
  • Sign up on our website to receive/download free resources
  • Fill out an intake form to schedule a free 30-min Clarity Call session
  • Use to the Contact form for any other requests and questions
  • Post a comment in response to one of our blog articles

What personal data we collect and why we collect it

Personal data means any information capable of identifying an individual. It does not include anonymised data. We may process the following categories of personal data about you.

TYPES OF PERSONAL DATA

(a) Communication Data that includes any communication that you send to us whether that be through the contact forms on the website, through email, social media messaging, social media posting or any other communication that you send to us. This can include name and contact information such as email adress, details related about your personal situation and the reasons that you are inquiring about our coaching services. We process this data for the purposes of communicating with you, for record keeping and for the establishment, pursuance or defence of legal claims. We also use this data to understand your particular coaching needs and provide you with the best service possible. Our lawful ground for this processing is our legitimate interests which in this case are to reply to communications sent to us, to keep records and to establish, pursue or defend legal claims.

(b) User Data that includes data about how you use our website and any online services together with any data that you post for publication on our website or through other online services. We process this data to operate our website and ensure relevant content is provided to you, to ensure the security of our website, to maintain back- ups of our website and/or databases and to enable publication and administration of our website, other online services and business. Our lawful ground for this processing is our legitimate interests which in this case are to enable us to properly administer our website and our business.

(c) Marketing Data that includes data about your preferences in receiving marketing from us, your communication preferences and comments you leave on our blog posts. We process this data to enable you to deliver relevant website content and advertisements to you and measure or understand the effectiveness of this advertising. Our lawful ground for this processing is our legitimate interests which in this case are to study how customers use our products/services, to develop them, to grow our business and to decide our marketing strategy.

SENSITIVE DATA

We do not collect any Sensitive Data about you. Sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. We do not collect any information about criminal convictions and offences.

MINORS

If you are a minor (under the age of 18), you can use this service only in conjunction with the consent and under the supervision of your parents or legal guardians.  If you are a minor, please do not submit any personal information to this website.  IF YOU ARE 13 YEARS OR YOUNGER, PLEASE DO NOT USE THE SITE OR ANY OF ITS SERVICES FOR ANY PURPOSE.

How we collect your personal data

CONTACT FORMS

We may collect data about you by you providing the data directly to us (for example by filling in contact and appointment forms on the website or by sending us emails).

COMMENTS

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

EMBEDDED CONTENT FROM OTHER WEBSITES

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

OPT-OUT OR UPDATING YOUR DATA

You can ask us to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you or OR by emailing us at [email protected] at any time.

If you opt out of receiving marketing communications this opt-out does not apply to personal data provided as a result of other transactions, such as using the contact form for other queries or booking a Clarity Call etc.

It is very important that the information we hold about you is accurate and up to date. Please let me know if at any time your personal information changes by emailing me at [email protected] OR clicking on the update your information links on any marketing message sent to you.

What do we do with your Data

(a) Promotional Use. Our lawful ground of processing your personal data to send you marketing communications is either your consent or our legitimate interests (namely to grow our business). We may use personal information about you to enhance our marketing and promotional efforts, and to improve our content and services.  We may also use your information to deliver to you advertisements, new services and promotions, and other information to you that is targeted to your interests.  You will have the ability to not receive such advertisements, promotions, notices and information by contacting The Expanded Way and requesting to no longer receive such notices, or by clicking “unsubscribe” on any email.

(b) Administrative Notices. We may use your e-mail address to contact you regarding administrative notices, new product offerings, and communications relevant to your use of the Site.  You will have the ability to not receive such advertisements, promotions, notices and information by contacting The Expanded Way and requesting to no longer receive such notices.

(c) Dispute Resolution. We may use information in the file we maintain about you, and other information we obtain from your current and past activities on the Site, to resolve disputes, troubleshoot problems and enforce our Terms and Conditions Agreement.

Who we share your data with

OUR DISCLOSURE TO THIRD PARTIES

We do not sell or give any personally identifiable information about you to any third party.  We use practices that are consistent with standards in the coaching industry to protect your privacy.  We cannot, however, promise that your personally identifiable information or private communications will remain private.  For example, third parties may unlawfully intercept or access transmissions or private communications on our website. (a) Disclosures Required by Law.  We reserve the right at all times to disclose any information about you as necessary to satisfy any applicable law, regulation, legal process or governmental request.   We reserve the right to fully cooperate with any law enforcement authorities or court orders requesting or directing us to disclose the identity of anyone posting any comments on the Site. By accepting this agreement you waive all rights and agree to hold us harmless from any claims resulting from any action taken by us during or as a result of any investigations and/or from any actions taken as a consequence of any investigation by either us or law enforcement authorities.

(b) Third-Party Suppliers. We may use third party suppliers to assist us in providing the services available on an outside website.  We impose contractual restrictions on the use by our third party suppliers of information concerning you, and we do not permit third party suppliers to sell your information to other third parties.

(c) Professional Advisers. We may share your personal data with professional advisers including lawyers, bankers, auditors and insurers.

(d) Service Providers. We may share your personal data with outside service providers who provide IT and system administration services, or general administrative services, or specialized services to support our business or customers.

(e) No Spam. The Site does not tolerate spam.  Therefore, without limiting the foregoing, you are not licensed to add The Site or The Expanded Way, including its agents and employees, to your mail list (e-mail or physical mail) without their express consent after adequate disclosure.

We require all third parties to whom we transfer your data to respect the security of your personal data and to treat it in accordance with the law. We only allow such third parties to process your personal data for specified purposes and in accordance with our instructions.

DISCLOSURES YOU MAKE TO THIRD PARTIES

We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy notice of every website you visit.

How we protect your Data

We have put in place security measures to prevent your personal data from being accidentally lost, used, altered, disclosed, or accessed without authorization. We also allow access to your personal data only to those employees and partners who have a business need to know such data. They will only process your personal data on our instructions and they must keep it confidential.

We have procedures in place to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach if we are legally required to.

How long we retain your data

We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

When deciding what the correct time is to keep the data for we look at its amount, nature and sensitivity, potential risk of harm from unauthorized use or disclosure, the processing purposes, if these can be achieved by other means and legal requirements.

For tax purposes the law requires me to keep basic information about my customers (including Contact, Identity, Financial and Transaction Data) for six years after they stop being customers.

For our blog, comments you leave and their metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights do you have

Under data protection laws, you have rights in relation to your personal data that include the right to request access, correction, erasure, restriction, transfer, to object to processing, to portability of data and (where the lawful ground of processing is consent) to withdraw consent. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive or refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it may take longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you.

If you are not happy with any aspect of how we collect and use your data, you have the right to file a complaint. We would be grateful if you would contact us first if you do have a complaint so we can try to resolve it for you.

Changes to Privacy Policy
